Council Regulation (EC) No 6/2002 on Community designs (CDR) protects the appearance of a design against counterfeiting and piracy, be it registered or unregistered. The right is applicable throughout the European Union. The registered design is obtained in a single procedure from the Office for Harmonization in the Internal Market in Alicante. This commentary gives a detailed article-by-article analysis of the provision of the Regulation and its enforcement in each Member State of the European Union. Wherever feasible, the commentary provides an account of specific bibliography, gives a historical overview, shows the main features and principles underlying the provision and analyses each paragraph with due regard to the case law of the European courts and the supreme courts of the Member States. In principle, the book is divided into two parts: Part I. Commentary of the CDR, and the Enforcement Directive 2004/48/EC. Part II. Enforcement of the CDR in the Member States of the European Union.
