Representing a continuation of the debate on export restrictions and export controls, this adroitly-crafted book expertly navigates the complexities of international trade law. Under the aegis of global security, it features a number of diverse yet interconnected topics on export restrictions and export controls and highlights the multi-faceted trade, economic, and security challenges faced by developed and developing countries.

Providing a wealth of legal analysis, Umair Ghori explores a variety of central themes including the role of export restrictions and controls and their differences, the impact they have on WTO Members international trade and economic security interests, the inadequacies of the rules on export restrictions and how this affects the interests of trading nations, and meaningful reforms in trade and development. Ghori draws on historical and theoretical dimensions and examines the latest developments within the field. Through the judicious use of empirical evidence, Export Restrictions and Export Controls illustrates the pressing need for reform of current WTO disciplines in order to support the aspirations and security interests of the developing world.

Both innovative and accessible, this book will appeal to academics, researchers and students of international trade and security studies, international economic law, trade law, and global and transnational law. Bringing a diverse perspective to scholarly discourse, it will also be of benefit to those interested in the wider field of international relations.

Recenzijas

Dr Ghoris excellent book on export restrictions and controls (Export Restrictions and Export Controls: From WTO to the Realm of Global Security) constitutes a timely and valuable contribution to the literature on international trade law and the rise of national security. At a time when export controls are increasingly being used as a weapon in trade disputes, a device to further protectionist policies and a way of pursuing the national security interests of individual states, Dr Ghori provides a clear exposition of international trade rules under the WTO and the ways in which these rules have been applied, limited and avoided. Dr Ghori picks three important and controversial examples of export controls and restrictions, focussing on health security, food security and the security related use of export controls in the US-China trade war, in order to develop his argument on the adverse effect these may have on international trade and particularly on the developing world. This book provides a clear and compelling discussion of the declining relevance of the WTO and its trade rules and the difficulties for states in attempting to reform the institution and the rules; the vulnerability of the developing world to unilateral actions through export restrictions and possible options to deal with export restrictions in the future. The book provides a coherent and convincing analysis of an area of international trade regulation that will continue to gain in importance in an era of trade decoupling and constitutes a very valuable guide to this difficult area of law and policy. Umair Ghori's Export Restrictions and Export Controls: From WTO to the Realm of Global Security is an incredibly timely and useful work. While deeply scholarly, well-researched, and with trenchant insights and analysis, the work is also of direct utility to current and future policymakers. The current second-term Trump presidency is likely to significantly elevate the relevance of Ghoris book, a rare distinction for academic writing, particularly a work as well-researched and conceived as this one. -- Colin Picker, RMIT University, Australia The books exploration of climate security as a dimension of export controls is particularly innovative. It addresses how export restrictions can be used as tools to mitigate the impacts of climate change, ensuring that countries can conserve their natural resources and promote sustainable development. This intersection of trade law and environmental policy is a significant contribution to the field, offering new pathways for legal and policy reforms that align with global sustainability goals. -- M. Sornarajah, National University of Singapore The author has tackled a difficult topic and analysed it well. We are drifting into an uncertain world and it is important to have work of this quality to combat the increasingly emotive debate on international relations and achieve the right balance in reform. -- John Farrar, Bond University, Australia This is a timely and informative contribution to the existing debate over the deployment of trade restrictive instruments for non-trade objectives, and whether the current global trading system and its rules are still fit for purpose. The dedicated and critical analysis of export measures addresses one of the major and perhaps fastest-developing challenges in this space, as governments increasingly resort to supply-side measures for strategic goals. The continued escalation of geopolitical tensions and superpower competition will only intensify this challenge and hence the debate about how best to reconstruct the system, on which this book will remain impactful for the foreseeable future. -- Weihuan Zhou, UNSW Sydney, Australia Within the brooding concepts of export restrictions and controls are multiple moving parts: economic development, climate change, food and health security, and legal and institutional adaption. In the context of current challenges to globalisation, Dr Ghori moves deftly through the many relevant topics with insight, analysis and evaluation and particularly with his own views on future changes. This is a superb work. -- Laurence Boulle, Author, The Law of Globalisation (Global Trade Law Series, Kluwer International). The book provides a holistic and updated analysis of export controls under WTO law. It sheds light on legal issues related to recent geopolitical tensions including the COVID-19 pandemic, the Ukraine war, and the USChina rivalry. Scholars and practitioners in international economic law and policy will find this book highly valuable. -- Pasha L. Hsieh, Singapore Management University
